Introduction
These Terms and Conditions govern your use of the Sigma Academy website and enrollment in our statistical training programs. By accessing our website or enrolling in our courses, you agree to be bound by these terms.
Please read these terms carefully before using our services. If you do not agree with any part of these terms, you should not use our website or enroll in our programs.
1. Definitions
- "Academy," "We," "Us," "Our" refers to Sigma Academy
- "Student," "You," "Your" means any person enrolling in or considering enrollment in our programs
- "Programs" or "Courses" refers to statistical training programs offered by Sigma Academy
- "Content" includes all course materials, lectures, problem sets, software, and documentation
- "Website" refers to all web properties operated by Sigma Academy
- "Services" encompasses all educational and related services we provide
2. Eligibility and Account Requirements
2.1 Age Requirement
You must be at least 18 years old to enroll in our programs. By enrolling, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement.
2.2 Account Information
When creating an account or enrolling in programs, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
2.3 Academic Prerequisites
You are responsible for ensuring you meet the academic prerequisites for programs you enroll in. We provide guidance on appropriate program selection but make no representations about your ability to complete coursework successfully.
3. Enrollment and Payment
3.1 Enrollment Process
Enrollment becomes binding when you submit payment and receive enrollment confirmation. Program availability is subject to sufficient enrollment and instructor availability. We reserve the right to cancel programs that do not meet minimum enrollment thresholds.
3.2 Tuition and Fees
Program tuition is stated in euros and must be paid in full before program commencement unless alternative payment arrangements have been approved in writing. Tuition covers course materials, software licenses during the program period, and access to instructors and discussion forums.
3.3 Cancellation and Refund Policy
- Before Program Start: Full refund if cancelled more than 14 days before program start date
- 7-14 Days Before: 50% refund if cancelled 7-14 days before program start
- Less Than 7 Days: No refund for cancellations within 7 days of program start
- After Program Start: No refunds after program has commenced
- Program Cancellation by Academy: Full refund if we cancel a program for any reason
Refunds are processed within 14 business days using the original payment method.
4. Acceptable Use Policy
4.1 Prohibited Activities
You may not:
- Share your account credentials or access with others
- Reproduce, distribute, or sell course materials without written permission
- Submit work that is not your own or violates academic integrity standards
- Disrupt course activities or harass instructors or fellow students
- Use automated systems to access or download content
- Reverse engineer software provided for educational purposes
- Attempt unauthorized access to our systems or other users' accounts
- Use services for any illegal purpose or in violation of applicable laws
4.2 Academic Integrity
You agree to uphold academic integrity standards including:
- Submitting only your own original work for assignments
- Properly attributing sources and collaborators
- Not sharing solutions to assignments with other students
- Following collaboration guidelines specified for each assignment
- Reporting suspected integrity violations
Violations may result in assignment failure, course expulsion, or termination of enrollment without refund.
5. Intellectual Property Rights
5.1 Our Intellectual Property
All course content, including lectures, problem sets, software, documentation, and assessments, is owned by Sigma Academy or our licensors and is protected by copyright, trademark, and other intellectual property laws. Your enrollment grants you a limited, non-exclusive, non-transferable license to access and use course materials solely for personal educational purposes during your enrollment period.
5.2 Your Content
By submitting assignments, participating in discussions, or contributing to collaborative projects, you grant us a non-exclusive license to use, reproduce, and display your submissions for educational and administrative purposes. You retain ownership of your original work.
5.3 Third-Party Software
Educational software licenses provided as part of programs are subject to the terms of their respective licensors. You agree to comply with all applicable software license terms.
6. Service Availability and Modifications
6.1 Service Availability
We strive to maintain continuous access to our website and learning platforms but cannot provide absolute uptime. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for service interruptions.
6.2 Program Modifications
We reserve the right to modify program content, schedules, or instructors when necessary to maintain educational quality or respond to unforeseen circumstances. Material changes will be communicated to enrolled students promptly.
6.3 Termination of Services
We may suspend or terminate your access to services if you violate these terms, engage in prohibited activities, or if required by law. Upon termination, your right to access course materials ceases immediately.
7. Disclaimers and Limitations of Liability
7.1 Educational Services Disclaimer
Our programs are provided for educational purposes and do not constitute professional certification, licensure, or employment placement. We make no representations about:
- Your ability to achieve specific learning outcomes
- Employment prospects or salary increases following program completion
- Acceptance of our certificates by other institutions or employers
- Suitability of statistical methods for specific applications
7.2 Service Warranty Disclaimer
Services are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for particular purpose, or non-infringement. We do not warrant that services will be uninterrupted, error-free, or meet your specific requirements.
7.3 Limitation of Liability
To the maximum extent permitted by Finnish law, our total liability for any claims arising from these terms or your use of services is limited to the amount of tuition paid for the specific program giving rise to the claim. We are not liable for:
- Indirect, incidental, consequential, or punitive damages
- Lost profits, revenue, data, or business opportunities
- Damages resulting from reliance on course content for professional applications
- Third-party claims arising from your use of services
- Issues arising from third-party software or services
8. Indemnification
You agree to indemnify and hold harmless Sigma Academy, its instructors, staff, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these terms, infringement of intellectual property rights, or misuse of services.
9. Dispute Resolution
9.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@domain.com to attempt informal resolution of disputes. We will work in good faith to address your concerns within 30 days.
9.2 Mediation
If informal resolution fails, disputes should be submitted to mediation through a mutually agreed mediator in Helsinki before pursuing other remedies.
9.3 Governing Law and Jurisdiction
These terms are governed by Finnish law. Any legal proceedings must be brought in the courts of Helsinki, Finland. You consent to the exclusive jurisdiction of these courts.
9.4 Class Action Waiver
You agree to bring claims individually and waive the right to participate in class actions or representative proceedings, to the extent permitted by Finnish law.
10. General Provisions
10.1 Entire Agreement
These terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and Sigma Academy regarding use of our services.
10.2 Severability
If any provision of these terms is found unenforceable, the remaining provisions continue in full force. Unenforceable provisions will be modified to reflect the parties' intent to the extent permitted by law.
10.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision. All waivers must be in writing to be effective.
10.4 Assignment
You may not assign or transfer these terms or your enrollment without our written consent. We may assign these terms to a successor organization in connection with a merger, acquisition, or sale of assets.
10.5 Force Majeure
Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, labor disputes, or technical failures. We will make reasonable efforts to reschedule affected programs.
11. Modifications to Terms
We may update these terms periodically to reflect changes in our practices or legal requirements. Material changes will be communicated through:
- Email notification to enrolled students and account holders
- Prominent notice on our website for at least 30 days
- Updated "Last Modified" date at the top of these terms
Continued use of services after notification constitutes acceptance of updated terms. If you disagree with changes, you may terminate your account subject to our cancellation policy.
